Firewater Activation Competition Terms and Conditions

Promoter Details  
The promoter of this competition is Edward Snell & Co, (Pty) Ltd registration number  
1999/021870/07, a company incorporated in the Republic of South Africa and having its  
registered address at Edward Snell and Company P.O. Box 26325b, Isipingo Beach, 4115 (the  
“Promoter”).

Eligibility  
This promotional competition (“Competition”) is open to all South African residents aged 18  
years and older who are in possession of a valid South African identity document. A passport or  
other documentary proof of South African residency may be provided but is not mandatory.  
The following persons are not eligible to enter:  
Any director, member, partner, employee, agent, or consultant of the Promoter, or  
any of their affiliates, marketing service providers, suppliers, or distributors.  
Immediate family members (spouses, life partners, business partners, or relatives) of  
any of the above.

Competition Period  
The Competition starts on 1st April 2026 and ends on 1st July 2026 (the “Campaign Period”).  
No late entries will be considered.

Entry Mechanics  
To enter the Competition, participants must:

Purchase the Firewater Promo i.e. 5 Shots for R100.  
Complete their details on the entry card provided.  
Entry card to be dropped (completed with all the necessary details) into the entry box  
located in the outlet.

Activation nights consumers will have the opportunity to instantly win Firewater  
Merchandise or a Bar Tab to the value of R1000 (Visa Card loaded with R1000) when  
they purchase the Firewater Promo (5 for R100) from the bar. They will receive a scratch  
card to reveal if they have won or not.  
Participants may enter multiple times, provided each entry corresponds to a separate purchase.  
Any suspected fraudulent activity, such as code manipulation, will lead to disqualification and  
may result in legal action.

Prizes  
The prizes are as follows:  
Stand a chance to win the Grand Prize of 5 tickets to any South African music  
festival of their choice. Flights and accommodation not included. Combined prize capped  
at R50 000 for all 5 tickets.  
By purchasing the promo on activation nights within specific bars the consumer  
will receive a scratch card where they could stand a chance to instantly win Firewater  
merchandise or a Bar Tab to the value of R1000. It is a preloaded visa card with R1000.

Non-Interchangeability of Prizes  
6.1.  
Prizes awarded in this Competition are strictly non-transferable, non-exchangeable, and  
cannot be redeemed for cash or credit under any circumstances. The Promoter will not provide  
any alternative compensation, cash equivalent, or substitute for the prize should the winner  
decline or be unable to accept the prize for any reason. Winners must accept the prize "as is,"  
and no requests for variations, substitutions, or cash payouts will be considered.  
6.2.  
Prizes are non-transferable and cannot be exchanged for cash or credit. If a specific  
prize is unavailable, the Promoter reserves the right to substitute it with another prize of equal  
value in compliance with the Consumer Protection Act.

7.1  
Winner Selection and Notification  
Grand Prize  
The winner will be randomly drawn after the Campaign Period. The Promoter will contact the  
winner telephonically within 5 working days. If the winner cannot be contacted or fails to verify  
their details within this period, the prize will be forfeited, and an alternate winner will be  
selected.  
The winner will be required to:  
Verify their identity by providing proof of identity and contact details.  
Consent to having their name announced publicly in line with the Promoter’s data  
protection policies.  
7.2  
Activation Spot prizes  
The winners will reveal if they are a winner by engaging in the scratch card mechanism. It  
will reveal if they are a winner or not. It will also reveal what prize they have won either  
Firewater merchandise or a Bar tab to the value of R1000.  
The winner will be required to:  
Verify their identity by providing proof of identity and contact details.  
Consent to having their name announced publicly in line with the Promoter’s data  
protection policies.

Winner Selection and Notification for Other Prizes  
All prizes not claimed or collected within one month of the prize draw will be deemed forfeited.  
9.  
Liability  
The Promoter, its agents, and suppliers will not be held liable for:  
Technical failures, such as website downtime or cyberattacks, that may impact entries.  
Loss, damage, or delays affecting prize delivery.  
Unused portions of any prize, which will be deemed waived by the winner.  
Events beyond its control, such as natural disasters or government restrictions, that may  
affect the Competition.  
10. Data Privacy  
By entering, participants consent to the processing of their personal information for  
Competition purposes. Personal data will be retained only as long as necessary for reporting,  
compliance, or legal purposes and in accordance with the Protection of Personal Information  
Act (POPIA). Further processing will require explicit participant consent.  
11.  
Intellectual Property  
Participants waive moral rights and grant the Promoter unlimited, perpetual, royalty-free rights  
to use Competition-related intellectual property created by participants. This applies exclusively  
to entries and does not include unrelated intellectual property. The Promoter may edit and use  
such material at its sole discretion.  
12.  
Dispute Resolution  
Disputes will be resolved via arbitration in accordance with South African law, with the  
arbitration decision being final and binding on all parties.  
13.  
Amendments and Termination  
The Promoter reserves the right to amend or terminate the Competition with 7 days’ notice in  
cases of unforeseen circumstances. Participants agree to waive any claims against the Promoter  
in such instances.

Social Media Disclaimer  
This promotion is not sponsored, endorsed, or administered by any social media platform.  
Participants acknowledge that they are providing information to the Promoter, not to any social  
media channel. The Promoter is not liable for data breaches or technical issues on these  
platforms.  
15.  
General  
Participation in the Competition constitutes acceptance of these terms and conditions. The  
judges’ decision is final, and no correspondence will be entered into.
